The 8 principles are: human, social, and environmental wellbeing; human-centred values; fairness; privacy protection and security; reliability and safety; transparency and explainability; contestability; and accountability. While they're voluntary for private sector, they're increasingly referenced in sector-specific guidance and form the baseline for what's expected.
Voluntary AI Safety Standard (September 2024)
On 5 September 2024, the Australian Government introduced the Voluntary AI Safety Standard as an interim measure while mandatory regulations are developed. The standard includes 10 guardrails that align with international standards including ISO/IEC 42001:2023, NIST AI Risk Management Framework 1.0, and EU AI Act principles (Department of Industry, Science and Resources, September 2024).
The 10 voluntary guardrails cover: accountability and governance (publish your processes), risk management (identify and mitigate risks), data governance and security (protect your systems), testing and monitoring (test before and after deployment), human oversight (enable meaningful human control), transparency (inform end-users about AI decisions), contestability (let people challenge AI outcomes), supply chain transparency (be transparent with other organisations), record keeping (maintain detailed processing records), and stakeholder engagement (evaluate needs with focus on safety, diversity, inclusion, and fairness).
Updated guidance published in October 2025 streamlined these 10 guardrails down to 6 key practices while maintaining alignment with Australia's AI Ethics Principles and international standards.
Proposed Mandatory Guardrails for High-Risk Settings
Australia released proposed mandatory frameworks to regulate high-risk AI settings alongside the voluntary standard. Public consultation closed in October 2024, with implementation not expected until 2026 at earliest (Verge Legal, 2024).
High-risk settings identified include healthcare, employment, finance, infrastructure, education, housing, insurance, and legal services. OAIC AI Guidance (October 2024)

Here's the critical restriction that catches many organisations off guard: just because data is publicly available or otherwise accessible doesn't mean it can legally be used to train or fine-tune generative AI models or systems (OAIC, October 2024).

Financial Services (ASIC, October 2024):
ASIC published REP 798 "Beware the gap: Governance arrangements in the face of AI innovation", warning that licensees are adopting AI technologies faster than they're updating their risk and compliance frameworks (MinterEllison, October 2024).
ASIC made clear that current regulatory frameworks are technology-neutral, applying equally to AI and non-AI systems. Use of AI must comply with obligations to provide financial or credit services "efficiently, honestly and fairly", must not lead to unconscionable actions towards consumers, and representations regarding AI use, model performance, and outputs must be factual and accurate.
Healthcare (TGA, 2024):
The Therapeutic Goods Administration published a report on "Clarifying and strengthening regulation of Medical Device Software including Artificial Intelligence (AI)" following consultation in September-October 2024 (Therapeutic Goods Administration, 2024).
Key finding: 91% of stakeholders confirmed the TGA's existing framework and technology-agnostic approach is robust enough to effectively regulate AI. Start With a Governance Policy
Your AI governance framework needs six components. Start with policy development and risk assessment. Add compliance alignment and technical controls. Build in ethical guidelines and continuous monitoring (Liminal, 2025).
The Department of Industry, Science and Resources provides a template that aligns with the Guidance for AI Adoption. It includes core principles and expectations for development, deployment, and use of AI systems (Department of Industry, Science and Resources, October 2024). SafeAI-Aus offers practical, open-source templates as a baseline AI governance toolkit that can be adapted to your organisation's context (SafeAI-Aus, 2024).
Seven-Step Implementation Framework:
1. Initial Assessment (Weeks 1-2):
Understand your organisation's current AI landscape before building governance structures. Catalogue all AI systems currently in use, under development, or planned. Identify where personal data is processed, where decisions affect individuals' rights, and where systems operate in high-risk settings.
2. Define Objectives (Week 3):
Establish what success looks like for your AI governance program. This isn't abstract philosophy. Define measurable outcomes like "zero regulatory breaches", "100% of high-risk AI systems undergo impact assessments before deployment", "documented human oversight for all customer-facing AI", and "bias testing completed for all recruitment and credit assessment tools".
3. Develop Roadmap (Weeks 4-6):
Create a roadmap outlining clear milestones for adoption of AI governance practices, including specific objectives, timelines, and responsibilities. Prioritise high-risk systems and customer-facing applications first.
4. Lifecycle Processes (Weeks 7-10):
Map essential processes for the entire AI model lifecycle. Establish protocols for risk assessments (before development starts), bias mitigation techniques (during training and testing), validation procedures (before deployment), and algorithmic transparency requirements (for ongoing operation).

Establish an AI Ethics Committee
Research identifies five high-level design choices for AI ethics boards: what responsibilities should the board have, what should its legal structure be, who should sit on the board, how should it make decisions and should decisions be binding, and what resources does it need (GovAI, 2024).
Board Composition:
Your board needs technical leaders who understand models and deployment. Legal and compliance officers who can interpret the AI Act and GDPR. Your data protection officer ensuring privacy compliance for AI projects. Cybersecurity managers who know AI systems are vulnerable to adversarial attacks. And risk management specialists to assess and mitigate AI-related risks (Gaming Tech Law, September 2025).
Decision-Making Authority:
The board needs real authority, not just the power to advise, but the power to pause or halt deployments when ethical concerns are unresolved. The committee should be authorised to make decisions on AI-related issues within the scope of its charter, including initiation, continuation, or termination of AI projects, and disposition of AI technologies used by company employees (NIRS, 2023).
Internal boards typically lack legal power to enforce decisions, relying instead on good relationships with management and the board of directors. However, if your company grants the board certain rights by creating a special class of stock or amending your charter, the board's decisions would typically be enforceable (Springer, 2023).
Charter Responsibilities:
Your charter should cover ensuring compliance with the charter and all relevant legal and ethical standards related to AI, monitoring and reviewing AI-related risks and issues while developing appropriate mitigation strategies, post-deployment oversight responsibilities, and receiving regular reports on model performance, incident trends, and system modifications that trigger re-review.
Define Roles: Chief AI Officer and Chief Data Officer
Chief AI Officer (CAIO):
The Chief AI Officer is a senior executive position responsible for overseeing artificial intelligence strategy, development, and implementation. It's typically the highest AI executive position within a company, leading the AI, data analytics, or machine learning department (Umbrex, 2024).
Key responsibilities include collaborating directly with senior leadership to make decisions on which AI initiatives to tackle and when, building a roadmap integrating data governance, model lifecycle management, and continuous monitoring of AI performance, overseeing budgeting, headcount, and procurement of AI technology, and setting well-defined KPIs for success measurement.
On the governance and ethics side, responsibilities range from regulatory compliance to integration of AI into corporate culture. Develop comprehensive AI ethics policies addressing bias, fairness, transparency, and accountability. Establish governance structures such as AI ethics boards or review committees to oversee deployment and mitigate risks.
Reporting structure varies. According to CIO's State of the CIO Study 2025, 40% of CAIOs report to the CEO, while 24% report to the CIO (CIO, 2024).
Industry projections suggest the Chief AI Officer role will become increasingly common in large enterprises through 2026, signalling a permanent shift towards AI-directed strategy at the highest executive levels.
Chief Data Officer (CDO) Evolution:
The federal CDO role has expanded to include data governance for AI. In 2024, there's continued momentum to align CDO responsibilities with supporting AI technologies. Deloitte's 2024 survey found 72% of CDOs now report into the C-Suite, emphasising the strategic weight their role carries, and 49% of CDOs are prioritising AI and generative AI as core priorities for the next 12 months (Deloitte, 2024).
The industry is moving towards more integrated roles like Chief Data and Analytics Officer (CDAO) or Chief Data and AI Officer (CDAIO), as the traditional CDO role has evolved from mainly overseeing data management to encompassing analytics and, more recently, artificial intelligence.
Risk Assessment and Impact Analysis
Conducting AI Risk Assessments
The NIST AI Risk Management Framework establishes a comprehensive methodology for AI risk assessment throughout the system lifecycle. The framework is technology-agnostic with a risk and principles-based approach. Your risk assessment process should be a continuous iterative process planned and run throughout the entire lifecycle of high-risk AI systems, with regular systematic review and updating required (NIST, 2023).
The NIST framework structures risk management around four core functions:
1. Govern:
Cultivate a culture and establish structures for managing AI risks. This includes setting up policies, assigning roles and responsibilities, establishing accountability, and ensuring senior leadership oversight.
2. Map:
Establish context to frame AI risks. Identify the AI system's purpose, context of use, potential impacts on individuals and society, and relevant legal and regulatory requirements.
3. Measure:
Employ appropriate methods and metrics to analyse and assess AI risks. This includes testing for bias, measuring performance across different demographic groups, assessing robustness to adversarial inputs, and evaluating explainability.
4. Manage:
Allocate resources to mapped and measured risks on a regular basis. Implement controls, monitor effectiveness, respond to incidents, and continuously improve (NIST, 2024).
Systems should be valid, reliable, safe, secure, accountable, transparent, explainable, privacy-enhanced, and fair with harmful bias managed. NIST released an updated Generative Artificial Intelligence Profile on 26 July 2024 to address specific considerations for generative AI systems.
Data Protection Impact Assessments (DPIA)
A DPIA is required under GDPR any time a new project begins that's likely to involve "high risk" to other people's personal information. Development of AI systems requires realisation of a DPIA if the envisaged processing is likely to create a high risk to rights and freedoms of natural persons (Article 35 GDPR). For all high-risk systems covered by the AI Act, realisation of a DPIA will be presumed necessary when development or deployment involves processing of personal data (GDPR.eu, 2024).
Required DPIA elements under GDPR Article 35 include: systematic description of envisaged processing operations and purposes of processing, assessment of necessity and proportionality of processing operations in relation to purposes, assessment of risks to rights and freedoms of data subjects, and measures envisaged to address risks.
Available templates include the UK Information Commissioner's Office DPIA template, Vrije Universiteit Brussel's Brussels Laboratory template conforming to Articles 35-36 of GDPR, and the European Data Protection Supervisor template for assessing whether a DPIA is required.
Here's an important efficiency gain: the Fundamental Rights Impact Assessment (FRIA) requirement can be met where FRIA elements are incorporated in one consolidated DPIA meeting requirements of both GDPR and the AI Act. This means one document will suffice.
Risk Mitigation Hierarchy
The EU AI Act Article 9 establishes a hierarchical risk mitigation approach that should guide your strategy:
1. Primary: Elimination Through Design
Your first priority is elimination or reduction of identified risks as far as technically feasible through adequate design and development of the high-risk AI system. This means building safety in, not bolting it on afterwards.
2. Secondary: Mitigation and Control Measures
Where appropriate, implement adequate mitigation and control measures addressing risks that can't be eliminated. These might include input validation, output filtering, confidence thresholds, or automated alerts.
3. Tertiary: Information and Training
Provide information required and, where appropriate, training to deployers. Give due consideration to the technical knowledge, experience, education, and training expected by the deployer, and the presumable context in which the system is intended to be used (Cambridge University Press, 2024).
Risk management measures must ensure the relevant residual risk associated with each hazard, as well as the overall residual risk of high-risk AI systems, is judged acceptable. Document your risk tolerance levels and the rationale for accepting residual risks.
Documentation and Transparency Requirements
Technical Documentation for High-Risk AI Systems
High-risk AI system providers must draw up technical documentation including training and testing processes and evaluation results, risk assessment and management procedures, data governance and quality measures, transparency and user information, human oversight mechanisms, and system architecture and design specifications.
Documentation must be maintained and kept up-to-date for a period of 10 years after the AI system is placed on the market or put into service (WilmerHale, July 2024).
Model Cards, Data Cards, and System Cards
Model Cards:
In their 2019 paper "Model Cards for Model Reporting", a group of data scientists including Margaret Mitchell, Timnit Gebru, Parker Barnes, and Lucy Vasserman created a documentation standard for AI models (ACM, 2019).
Model cards provide detailed information about the ML model's metadata, datasets it's based on, performance measures it was trained on, and deep learning training methodology. They're becoming an industry standard for transparent model reporting.
Data Cards:
Data Cards are structured summaries of essential facts about various aspects of ML datasets needed by stakeholders across the dataset's lifecycle for responsible AI development. They provide explanations of processes and rationales shaping data and consequently models, such as upstream sources, data collection methods, and annotation methods (ACM, 2022).
System Cards:
System Cards summarise risks, mitigations, and performance metrics at the system level for deployed models, focusing on operational deployment rather than just model characteristics.
Policy Cards (Emerging Framework):
Policy Cards are a deployment-layer, normative, and audit-oriented specification for AI systems and agents. A Policy Card encodes concrete operational constraints of a deployed system including allowed and denied actions, escalation requirements, time-bound exceptions, evidentiary logging, and mapping to governance frameworks in a structured, machine-readable format (arXiv, October 2025).
Logging and Audit Trail Requirements
GDPR Accountability Principle:
Article 5(2) states the data controller must be able to demonstrate compliance with core data protection principles outlined in Article 5(1). Audit trails provide the necessary evidence to meet this accountability requirement by creating a chronological record of events related to document access and handling (CookieYes, 2024).
Article 30 compels organisations to audit and record how personal data is being used, requiring each controller to maintain a record of processing activities under its responsibility.
What Should Be Logged:
Who accessed personal data (user ID or IP address), when and why data was accessed (timestamped logs with justifications), types of data collected and processed, data access logs (every instance of personal data access and requests made), and data modifications (all changes made to personal data, including what changes, who made them, when they were made).
Logs should be securely stored and protected against tampering. While encryption isn't explicitly required, it's a recommended security measure under Article 32. Meta-logging requirements mean you should record who accessed primary logs, when they did so, and any operations performed.
Organisations should establish a data retention policy specifying how long logs are kept based on legal and operational requirements, ensuring personal data isn't held longer than necessary, adhering to GDPR's data minimisation principle.
The Spanish Data Protection Agency published guidance on audit requirements for personal data processing activities involving AI, providing a framework for AI system audits under GDPR (AEPD, 2024).
Transparency Obligations to Users
EU AI Act Article 50:
Companies must inform users when they're interacting with an AI system unless it's obvious or used for legal purposes. Provide clear notification when using emotion recognition or biometric categorisation, disclose that content is artificially generated (deepfakes), and disclose text generation when published to inform the public on matters of public interest. Information must be provided at the latest time of first interaction or exposure (AI Act Service Desk, 2024).
Australian Context:
OAIC guidance recommends organisations update privacy policies clearly disclosing AI usage, clearly identify public-facing AI tools (chatbots) to users, provide notice at collection about AI involvement, and establish formal policies governing AI system deployment (OAIC, October 2024).
Records Retention for AI Systems
Many companies using AI lack clear retention rules for data used in model training or inference. AI projects present unique challenges as data flows through multiple environments: collection, preprocessing, training, evaluation, and monitoring (VerifyWise, 2024).
Some AI systems require reprocessing of historical data for model retraining or auditing. AI models trained on personal or regulated data may retain characteristics of that data even after deletion. Without clear retention timelines and disposal mechanisms, organisations risk violating data minimisation principles and legal limits on processing duration.
Data quality underpins AI. Clean data ensures AI tools deliver trustworthy results. Unmanaged ROT (redundant, obsolete, trivial) data directly reduces quality and trustworthiness of AI outputs. For AI governance and compliance teams, data retention policies help balance privacy, legal, and operational requirements.
GDPR requires data to be stored "no longer than necessary" but doesn't define exact durations. You must assess necessity and document your decisions.
Bias Testing, Fairness Audits, and Monitoring
Detecting and Measuring Bias
Bias detection frameworks include IBM AI Fairness 360 (provides metrics to evaluate bias across different dimensions), Google's What-If Tool (enables exploration and testing of machine learning models), and Aequitas (an open source bias and fairness audit toolkit enabling users to test models for several bias and fairness metrics in relation to multiple population sub-groups) (arXiv, 2018).
